Marriage-Based Green Cards

If you are applying for a green card but your marriage ends in divorce before the process is complete, we may be able to use legal options to help keep you in the country, such as an I-751 petition waiver or relief under Violence Against Women Act (VAWA). Our attorneys in Middlesex County have been able to assist many of our immigration clients continue with the green card application process even after they divorced from their U.S. citizen spouse. We also help with business immigration law. Our team is also extremely experienced in Special Immigrant Juvenile Status, which allows some children who have been abandoned, neglected or abused by one or both parents to acquire their permanent residence in the United States.

I-601 and I-601A Waivers

Our dedicated Middlesex County attorneys regularly prepare and submit I-601 and I-601A waivers on behalf of our immigration clients. If you are trying to get a green card (permanent residence) but the government denies your application on the grounds that you are “inadmissible,” you may need to file one of these waivers (if eligible). For people who have entered the country illegally, an I-601A Provisional Unlawful Presence Waiver may be appropriate. For people who are inadmissible because of other reasons, such as a criminal history or fraud, an I-601 Waiver of Grounds of Inadmissibility might be the best option.

Family-Based Immigration

Our Middlesex County lawyers are highly experienced in keeping families together throughout the immigration process. Green cards may be available in certain situations for spouses, children, parents, brothers, and sisters of U.S. citizens. Visas might also be available for the family members of people in the U.S. on a temporary work visa, such as an H-1B visa, O-1 visa, or L-1 visa. Our knowledgeable attorneys can evaluate whether any of these options are appropriate for you and handle the family-based immigration process from beginning to end.

For instance, an immigrant can be eligible for a green card through an immediate relative if they:

  •  Entered the United States with inspection at an authorized port of entry (such as a border crossing, airport, or port).
  • Have not committed, admitted to or have been convicted of certain crimes which would prevent them from obtaining permanent residence.
  • Be otherwise eligible. There are numerous reasons why people may not be eligible, including unauthorized stay in the United States, criminal history, prior deportation/removal orders, and admissibility bars for remaining in the United States without authorized stay and then departing the United States.

If your relative is not in the United States, they will need to go through the consular process.  If there is an immigrant visa immediately available, and they are otherwise eligible, we can help them immigrate to the United States as quickly as possible.

Additionally, permanent residence can be attained through non-immediate relatives (including spouses, children and unmarried sons and daughters of lawful permanent residents, married sons and daughters of U.S. citizens, and brothers and sisters of U.S. citizens). However, in these cases additional eligibility requirements must be met, and visas are not immediately available. The waiting period to attain a green card through one of these non-immediate relatives can be many years.

Finally, family-based immigration often includes fiancé(e) visas.  Our attorneys are experienced in the fiancé(e) based visas and can guide you through that process.

Deportation/Removal Defense
