New Massachusetts Child Support Guidelines Will Change Child Support On June 15, 2018

Massachusetts Releases New Child Support Guidelines

In 2017, the Massachusetts Child Support guidelines were reworked.  The new guidelines granted discounts to children over the age of 18.  This was generally done to allow for the fact that they might continue as dependent even as they spend more time out of the house for college.  The 2017 guidelines were actually a blessing to many custodial parents who struggled with child support at the same time as hefty tuition payments arrived.  After being released, practitioners began noticing odd results from the application of the 2017 guidelines.  Most of the issues that occurred were simply errors in the math that actually gave discounts to additional children or medical expenses that would wipe out the increase in child support from an additional child.

The New Guidelines Claim to Fix These Errors

The 2018 guidelines, which go into effect on June 15, 2018, claim to fix these errors and simplify the analysis.  They have changed the procedure to calculate the child support payments for shared custody (50% or 2/3 time), so that one form can be used to calculate the child support payment.  These changes seem to have reversed many of the gains seen by custodial parents under the 2017 guidelines.  They do, however, make the calculator more straightforward and predictable for families with more than one child, especially where there are a mix of under and over 18 year old children.

Care must be taken with modifications

Because of these new changes, analyses for modifications and complaints filed must take into account the change in the child support guidelines.  This is especially true of modifications that were initially filed while the 2017 child support guidelines have been in force but have not gone to judgment, as the calculations will have changed.
