US Citizenship and Immigration Services (USCIS) has acknowledged significant delays in the processing of Form I-765 for Employment Authorization Documents (EADs).  These delays have continued to get longer.  Although USCIS took steps to automatically extend EADs for certain classes of applications, the delays have extended past the 6 month period of the automatic extensions for many.

Numerous Applicants Left Unemployed by Delays

These delays have led to numerous people having breaks in their employment authorization where they are simply left with the decision: stop working, or work unlawfully.  Despite repeated requests from attorneys and applicants, USCIS has so far made few attempts to remedy the inexplicable delays.  Persons applying for an adjustment of status are lawfully supposed to receive their work authorization within 90 days; current waiting times are 6-8 months.  This means that there are spouses who are eligible for work permits as they await their green card interviews who simply can’t do anything in the United States but wait.

No answers

Unfortunately, there are no clear answers as to how to fix this.  Our firm has been making all efforts to simply manage expectations by our clients, making certain they understand that they will simply need to be patient.
